29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or (3) When the employer has reason to believe that any affected employee does not have the understanding and skill required; At the jobsite, where employees performing roofing activities were exposed to fall hazards up to approximately 24 feet, did not receive retraining on hazard recognition and avoidance to fall hazards at heights over 6 feet to the ground below. Jesus Vega Acosta was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 1926.503(c), which was contained in OSHA inspection number 1697657, Citation Number 2, Item number 2, and was affirmed as a final order on October 16, 2023, with a final abatement date on October 6, 2023, with respect to a workplace located at 1849 Rough Ridge Drive, Midlothian, TX 76065.
