29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) Mill Area: On or about March 9, 2016, and times prior, employees operate chainsaws, such as the Stihl MS362 with 24" bar, Stihl Super 029 with 24" bar, and Stihl MS290 with 18" bar, to cut boards and logs to specified lengths, without the use of leg protection. Wayne Lumber and Mulch, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, Personal Protective Equipment, which was contained in OSHA inspection number 961178, citation number 1, item number 4a and was affirmed as a final order on September 25, 2014, with respect to a workplace located in Wayne, WV.
