29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: The employer does not protect each employee from hazards of falling and allows them to use a portable ladder without its side rails extended at least 3 feet above the upper landing surface for access and egress. a) This most recently occurred on February 15, 2022, at 19 Terra Vita Ct., South Barrington, Illinois 60010. Employees are using a portable ladder to access and egress an upper landing surface that do not have side rails extended at least 3 feet above the surface. Emerald Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1476144, citation number 1, item number 2a and was affirmed as a final order on January 15, 2021, with respect to a workplace located at 751 Meacham Rd. Elk Grove Village, IL 60007. To abate this hazard in the future, the employer must ensure that employees are using a portable ladder that have its side rails extended at least 3 feet above the working surface for access and egress. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.
