Investigation Summary

At approximately 8:40 a.m. on November 8, 2007, Employee #1, of Pro-Tech Caulking & Waterproofing, was engaged in hot work in an open area at ground level, sealing the floor of a building under construction against water intrusion and filtration. Coworkers from Permik Steel Erectors, Inc., knocked a C-clamp over the toe board of a scissor lift. The clamp struck the balcony floor and then fell 43 stories, striking Employee #1 on the head. His hard hat was destroyed by the impact and he was killed. Employee #1 had been trained on safety subjects such as fall protection, PPE, and hazardous communication. The company had a safety program and conducted regular talks and training with employees. At this site, the general contractor required that all subcontractors prepare and submit daily reports on the work to be performed, and safety practices expected to be followed. There were three coworkers helping Employee #1 when the accident occurred, but none of them witnessed the accident.
